PRIVACY INFORMATION

1. PURPOSE OF DATA PROCESSING

This privacy notice, provided to data subjects pursuant to Article 13 of Regulation (EU) 2016/679, refers to the present mobile application (hereinafter the "App" or "Hi, it’s oN me"). It forms an integral part of the App and the services offered through it and applies to personal data, including special categories of data pursuant to Article 9 of the Regulation, voluntarily provided by the user following the acceptance of the license agreement.

To access the services provided by the App through account creation, users are required to register by providing the following personal data: nickname, email address, and password. When the user installs or uses the App, the App collects specific information about the device used, the connection, and location data.

If the user uses third-party services integrated with the App (e.g., payment services), they will provide personal data directly to those third parties, who are independently responsible for their processing. While using the services connected to the App, users may voluntarily provide additional personal data, as well as upload images and videos. The personal data collected may be shared with other users of the App.

Registration to the App is allowed only for individuals over the age of 18. For minors, parental or guardian consent is required. However, the Controller cannot monitor access by minors to registration forms. Any false declarations by users under 18 are presumed to have been made with parental or guardian authorization, who will then be held responsible for the minor’s behavior regarding access to the App, consent provided, and use of the services.
When registering and using the App, the processing of third-party personal data may occur. As the registering subject and regarding third-party data (including that of minors), you hereby declare – taking full responsibility as an autonomous controller – that you have obtained the required consent and authorization from the third party to communicate such data to Genia Business, fully indemnifying the Controller against any disputes, claims, or requests for damages that may arise from the processing of such data via the App and its services.

2. PURPOSES OF THE PROCESSING

GENIA BUSINESS processes personal data collected via the App for the following purposes:

1. to provide the requested services (e.g., to allow registration and access to the App; to provide related services; to upload images and videos, etc.), including all related administrative, accounting, logistical, and organizational requirements, and to manage the user’s private area;

2. for statistical and scientific research purposes using aggregated or anonymous data, ensuring that individuals cannot be identified;

3. to comply with obligations imposed by current laws, regulations, or EU legislation;

4. to send promotional and informational materials regarding Genia Business's activities. You may withdraw your consent to such communications at any time, whether via traditional or automated methods, by contacting the Controller without formalities at: privacy@hi-itsonme.com.

3. METHODS OF PROCESSING AND DATA RETENTION

Personal data is processed mainly in electronic form, but also in paper form, for the time strictly necessary to achieve the purposes for which they were collected and in accordance with Article 32 of the GDPR 2016/679, by personnel specifically appointed for this purpose.
Personal identity data are stored for the legally required period, while personal data within the private area and the account itself are automatically deleted by the Controller one year after the termination of the contractual relationship.
Users can delete their accounts at any time using the specific feature in the App, which will terminate data processing and lead to deletion of the data from the data processor’s servers.
In this case, the user acknowledges that data previously shared with other users may remain visible and retained by third parties, for which the Controller and Processor assume no responsibility.

The data processing related to this App's services is carried out locally on the user’s mobile device and on the servers of the Processor, Information Technologies S.r.l., located in Italy, and is entered into the company’s information system in full compliance with applicable regulations, including security and confidentiality requirements, and in accordance with the principles of fairness and lawfulness (Articles 5, 6, and 32 of Regulation EU 2016/679).

The Controller does not implement any automated decision-making processes within the meaning of Article 22, paragraphs 1 and 4, of Regulation EU 679/2016.

4. MANDATORY OR OPTIONAL NATURE OF DATA PROVISION

For the purpose described in point 2a), providing consent is mandatory to use the services. Failure to provide such data will prevent service activation.

For the purpose in point 2b), the provision is optional. Failure to provide this data will not impact the registration/activation process.

For the purpose in point 2c), data provision is mandatory. Without it, the Controller cannot fulfill legal, regulatory, or EU obligations.

For the purpose in point 2d), the provision of data for marketing and/or promotional purposes is optional. Failure to provide this data will not affect the ability to activate or use the App.

5. DATA DISCLOSURE AND DISSEMINATION

Your personal data may be disclosed to:

1. individuals, companies, or professional firms providing assistance and consultancy to Genia Business S.r.l. in the areas of accounting, administration, legal, tax, and finance, in relation to the services provided and App usage;

2. entities, organizations, or authorities to whom data must be disclosed by law, regulation, or order of the authorities;

3. persons authorized by Genia Business under Article 4, point 10 of Regulation EU 2016/679 to perform tasks closely related to service provision, or, where necessary, external processors pursuant to Article 28 of the same Regulation.

Aside from the above, your personal data will not be disseminated.

6. DATA SUBJECT'S RIGHTS

At any time, the user may exercise the rights granted under Articles 15 to 22 of Regulation EU 2016/679, specifically the right to:

1. request confirmation of whether their personal data is being processed;

2. obtain information on the purposes of the processing, categories of data processed, recipients or categories of recipients to whom the data has been or will be disclosed, and, when possible, the retention period;

3. request rectification or erasure of data;

4. request the restriction of processing;

5. receive their data in a structured, commonly used, and machine-readable format, and transmit it to another controller without hindrance (data portability);

6. object to processing at any time, including processing for direct marketing purposes;

7. object to automated decision-making, including profiling;

8. request access to personal data from the Controller, or request rectification, erasure, or restriction of processing, or object to processing, including data portability;

9. withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal;

10. lodge a complaint with the Data Protection Authority.

The Controller may amend or update this privacy notice, in whole or in part, due to changes in applicable laws and regulations. Such changes will be communicated to users by email and will become binding upon receipt. We encourage users to regularly visit this section to stay informed about the latest version of the privacy policy and how their data is used.

7. DATA CONTROLLER AND DATA PROCESSOR

Following the installation of the App and use of the services it provides, personal data relating to identified or identifiable individuals may be processed. The data controller and manager of the App is:

Pursuant to Article 28 of the GDPR, the external data processor is the company IT - Information Technologies S.r.l., located in Via Ferrarese 219/7, Bologna (40128 - BO), which provides App maintenance services.
